The agreement
These terms are an agreement between you and Design+Code (“we”, “us”), which operates Fil at fil.design, including its studio, public pages and MCP server. By creating an account or using Fil you accept them and our Privacy Policy. If you use Fil for an organisation, you accept them on its behalf and confirm you’re allowed to.
You must be at least 18, or the age of majority where you live if that’s higher.
Your account
You sign in with Google or with a code sent to your email, so keep that email secure: anyone who can read it can sign in as you. An account is for one person; don’t share yours.
You’re responsible for what happens under your account, including what agents and scripts do with your agent keys. We may limit who can sign up, or who can use particular features or models.
Credits, plans and payments
- Credits pay for runs. Each run’s price is shown before it starts, and a run can’t cost more than the maximum shown.
- Failed runs are refunded. If a run fails or its provider blocks it, its credits come back automatically. If you cancel a run that has started, credits for work the provider has already done may still be used.
- Plans are billed in advance through Stripe, monthly or yearly, and renew automatically until you cancel. Cancelling stops the next renewal; your plan runs to the end of the period you’ve paid for.
- Monthly credits arrive each month of a plan, yearly plans included. Unused ones roll over for one more month, then expire. Purchased credit packs don’t expire while your account is open. Monthly credits are spent first.
- Teams. A team’s owner can move purchased credits into it, buy credits for it and pause its spending; members who can edit spend them. Credits we give you for free, such as the Free plan’s welcome credits, stay with you and can’t be moved to a team.
- Credits have no cash value and can’t be sold, moved outside Fil or exchanged for money.
- Refunds. Payments aren’t refundable, except where the law requires it or we charged you in error; write to us within 30 days if something looks wrong. If a payment is reversed or disputed, we may pause the credits it bought until it’s settled.
- Prices are in the currency shown at checkout and may exclude taxes. We’ll tell you before a price change applies to your plan.
Nothing in these terms limits rights you have as a consumer where you live.
Your content
You keep ownership of what you put into Fil (prompts, files and documents) and, as between you and us, of what Fil generates for you. You give us the permission we need to store, process and show that content to run Fil for you and your teams, including sending it to model providers as the Privacy Policy describes.
Commercial use of outputs is included with the plans that list a commercial licence on our Pricing page.
Explore. When you share a file to Explore, you let us show it on Fil’s public pages and let anyone view it and reuse its prompt, for as long as it’s shared. You can unshare it at any time.
AI output can be inaccurate, can resemble existing work, and may not be protected by copyright where you are; others may get similar results from similar prompts. Check outputs before relying on them, and make sure you have the rights to the files, likenesses and brands you use as references. Runs are also subject to the usage policies of the provider that runs them.
Acceptable use
Don’t use Fil to:
- Make or share any content that sexualises minors.
- Make sexual or intimate images of a real person without their consent, or pass off generated images, video or audio of real people as genuine.
- Harass, threaten, defame or impersonate anyone, or promote violence or hatred against people for who they are.
- Infringe anyone’s intellectual property or privacy.
- Break the law or help someone else break it, including fraud, scams and malware.
- Get around provider safety filters, credit limits or access controls, or test Fil’s security without our permission.
- Overload or scrape Fil, or resell or share access to it, including your agent keys.
We may remove content, block runs or suspend accounts that break these rules, and report illegal content to the authorities.
Agents and the MCP server
Agent keys, and apps you approve over MCP, act as you, with your teams, roles and credits. Keep keys secret, set daily caps you’re comfortable with, and revoke a key or disconnect an app as soon as you stop trusting it. Paid tools ask the agent for a credit limit before they run, but you’re responsible for the runs your agents start.
Teams
A team’s owner manages its members, roles, credits and billing, and is responsible for who they invite. What you add to a team workspace is visible to its members, and copying a file into a team shares that copy with them. If you leave or are removed, you lose access to the team’s work; your personal workspace isn’t affected.
Other people’s content
Fil’s public pages show work other people have shared and images from libraries such as Aura Assets, credited to their sources. They belong to their owners: reusing a prompt or opening an image on a canvas doesn’t give you rights to the original, so check its source’s licence before using it in your work.
Changes and availability
We may add, change or remove features and models, and model providers may change their prices, limit access or go offline. We’ll try to give notice of major changes, but we don’t promise that Fil, or any particular model, will always be available or free of errors.
Ending your use
You can stop using Fil at any time and ask us to delete your account, as the Privacy Policy describes. We may suspend or close an account that breaks these terms, puts Fil or other people at risk, or that the law requires us to close. Where it’s reasonable, we’ll tell you first and give you time to download your work.
Disclaimers
Fil is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including that Fil or its outputs will be accurate, fit for a particular purpose or free of infringement.
Limitation of liability
To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability for any claim about Fil is limited to the greater of what you paid us in the 12 months before the claim and US$100. Nothing here limits liability that the law doesn’t allow us to limit, such as for fraud, or for death or personal injury caused by negligence.
Indemnity
If someone makes a claim against us because of your content or your breach of these terms, you’ll cover our reasonable losses and costs from it, to the extent the law allows.
Changes to these terms
We may update these terms. We’ll post the new version here with its date and tell you by email or in the studio before material changes take effect. If you keep using Fil after that, the new terms apply; if you don’t agree, stop using Fil and ask us to delete your account.
Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over disputes about them. You keep any right your local consumer law gives you to bring a claim where you live.
If part of these terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver of it. You can’t transfer these terms to someone else; we may transfer them to whoever takes over Fil.
